Es gibt einen Zusammenhang zwischen der Debatte über die Zukunft der Privatsphäre und der über die Zukunft des Urheberrechts. Hintergrund ist, dass wir am Beginn eines neuen Zeitalters stehen. Das ‘Buch und Schallplatte’ Zeitalter zeichnete sich dadurch aus, dass die Verbreitung von Informationen kostenintensiv war. Bücher und Schallplatten mussten hergestellt, transportiert und vorgehalten werden. Es erforderte einen immensen ökonomischen Aufwand, ein Kulturgut überhaupt zugänglich zu machen. Dieser Aufwand führte dazu, daß eine Publikation Ökonomisch rechtfertigt werden musste und führte zu der Frage, warum etwas veröffentlicht werden sollte. (ist es massenkompatibel etc.).
Das Internet als neues Medium vereint nun die Speicherfähigkeit der Bibliothek mit der Verfügbarkeit des Rundfunks und ermöglicht es, dass jede Information zu jeder Zeit an jedem Ort abrufbar ist. Ein grundlegendes Paradigma hat sich damit umgekehrt. Der Zustand, der früher jedesmal aufwendig hergestellt werden musste, ist jetzt der Normalfall für jede Information. So verbreiten sich Kulturgüter gegen den Willen einer Verwerterindustrie, deren primärer Sinn und Zweck einmal darin bestand, diese Verbreitung überhaupt zu ermöglichen oder die gesamte Kommunikation der US Diplomaten gelangt auf einen Schlag an die Öffentlichkeit.
Jede Information ist nun von Natur aus Öffentlich im Sinne der Zugänglichkeit, und jede Information, die es nicht ist, strebt regelrecht in diesen Zustand. Jede Geheimhaltung ist dreifach kostenintensiv: Es ist teuer, ein Geheimnis aufrechtzuerhalten, es ist teuer, das Risiko zu managen, dass die Geheimhaltung nicht gelingt und es ist teuer aufgrund von Opportunitätskosten, weil Netzwerkeffekte nicht ausgereizt werden können. So hat die US Regierung nach den Wikileaks-Vorfällen z.b. beschlossen, den Zugang zu Dokumenten innerhalb der Behörden wieder Einzuschränken, d.h die Behörden wieder weniger zu vernetzen.
Die Umkehrung dieses Paradigmas führt auch zu einer Umkehrung der Fragestellung. In einer Welt, in der die Öffentlichkeit im Sinne der Zugänglichkeit der Normalzustand jeder Information ist, stellt sich die Frage nicht mehr, warum etwas veröffentlicht werden soll. Die Veröffentlichung ist kein Akt mehr, der begründet werden muss, sondern ergibt sich von selbst. Umkehrt wird nun das Vorenthalten einer Information zu einem Akt, der angesichts des Aufwands auch einer Rechtfertigung bedarf. Für junge Menschen, die mit sozialen Netzwerken und Fotohandys aufwachsen, stellt sich nicht die Frage, warum sie Fotos von sich ins Netz stellen wollen, sondern warum sie den Aufwand betreiben wollen, alle ihre Freunde und Bekannte davon abzuhalten, sie zu Fotografieren. Es geht also nicht nur darum, daß sich unter diesen Bedingungen keine Informationen verkaufen lassen, sondern auch für die peinlichsten dinge des (sogenannten) Privatlebens stellt sich nicht mehr die Frage, “warum möchte ich es der Welt um jeden Preis erzählen ? ” sondern “warum möchte ich es der Welt um jeden Preis vorenthalten, und wozu ?”
